This Privacy Policy explains what personal information we collect through the Elixir Muscle Recovery mobile app and the website at elixirmuscle.com (together, the “Services”), how we use it, who we share it with, and the choices you have.
1.Who we are and what this policy covers
This Privacy Policy explains what personal information we collect through the Elixir Muscle Recovery mobile app and the website at elixirmuscle.com (together, the “Services”), how we use it, who we share it with, and the choices you have.
The Services are operated by Elixir Muscle Recovery Franchising, LLC (“Elixir,” “we,” “us,” or “our”). Elixir Muscle Recovery locations and mobile units are owned and operated by independent franchise operators (“Operators”), often inside a gym, club, or athletic venue (a “Host Facility”). When you book or use services at a location, the Operator of that location also receives and uses your information to serve you, as described below.
By creating an account or using the Services, you agree to this Privacy Policy. If you do not agree, please do not use the Services.
2.Information we collect
Information you give us
- Account and contact details: name, email address, phone number, date of birth or age confirmation, password, and the franchise city or location you select.
- Booking and membership details: sessions you book, hold, attend, or cancel; your membership tier, passes, add-ons, discount codes, free-trial use, and check-in codes.
- Payment information: payments are processed by our payment processor (Stripe, including Apple Pay where offered). We and the Operator receive confirmation of payment, the amount, and limited card details such as card type and last four digits. We do not store full card numbers.
- Health and intake information: medical conditions, injuries, medications, and other health details you choose to provide on intake or screening forms.
- Waiver and agreement records: the version of each agreement you accept, the date and time you accepted it, and the account and device used.
- Emergency contact: the name, relationship, and phone number of the person you list. Please make sure that person knows you have shared their details.
- Family and guest details: names and ages of family members, minors, or guests you add to your account.
- Communications: messages, reviews, survey answers, and anything else you send us, including through website contact or franchise inquiry forms.
Information collected automatically
- Device and usage data: IP address, device and browser type, operating system, pages and screens viewed, and the dates and times of your activity.
- Location: your approximate location from your IP address and, if you allow it in your device settings, your precise location so the app can show nearby locations and mobile unit stops.
- Cookies and local storage: small files stored on your device that keep you signed in and remember your preferences. See Section 6.
Information from others
We may receive information about you from Operators, Host Facilities, a member who adds you as a family member or guest, and service providers such as payment and analytics companies.
3.How we use your information
We use personal information to:
- create and manage your account and membership;
- schedule, hold, and check you in to sessions, and show you locations and mobile unit stops;
- process payments, refunds, and discount codes;
- record your acceptance of waivers and other agreements;
- review intake information for safety screening and respond to incidents or emergencies;
- send service messages such as booking confirmations, reminders, schedule changes, and account notices;
- send marketing messages where you have agreed to receive them (see Section 7);
- operate, secure, troubleshoot, and improve the Services;
- support Operators and maintain quality and safety standards across the Elixir system;
- detect and prevent fraud, misuse, and unauthorized access; and
- comply with the law and establish, exercise, or defend legal claims.
4.How we share your information
We do not sell your personal information. We share it only as follows:
- Operators. The independent Operator of each location you select, book, or visit receives your account, booking, payment status, waiver, intake, and emergency contact information in order to serve you. Each Operator is responsible for its own handling of that information.
- Host Facilities. We or the Operator may share limited information with the Host Facility where a location operates, such as your name and booking time, for access, check-in, and safety purposes.
- Service providers. Companies that work on our behalf, including payment processing (Stripe), website and app hosting, email and text message delivery, analytics, and customer support. They may use your information only to provide services to us.
- Family and guests. If you are part of a family or guest add-on, the account holder may see your bookings.
- Insurers and professional advisors. Insurers, legal counsel, and accountants, where needed for safety review, claims, or advice.
- Legal and safety. When required by law or legal process, or when we believe disclosure is needed to protect the rights, property, or safety of you, us, Operators, or others, including sharing information with emergency responders.
- Business transfers. In connection with a merger, sale, financing, or transfer of all or part of our business or an Operator’s business, including the transfer of a location from one Operator to another.
- With your consent. In any other case where you ask or allow us to share it.
5.Health and wellness information
Elixir Muscle Recovery services are wellness and recovery services, not medical treatment. Neither we nor Operators are health care providers, and neither is a “covered entity” or “business associate” under the Health Insurance Portability and Accountability Act (HIPAA). Health information you provide is not protected health information under HIPAA and is not a medical record.
We still treat this information with care. We collect health and intake information only when you choose to provide it, and by providing it you consent to its collection and use as described here. We and the Operator use it for safety screening, session suitability, incident response, quality and safety review, and the defense of claims. We share it only with the Operator, our service providers, insurers, legal counsel, and successors, or as required by law. We do not use it for advertising and do not sell it.
6.Location, cookies, analytics, and recording
Location. The app shows where locations and mobile units are. It uses your own precise location only if you turn on location permission, and you can turn it off at any time in your device settings. Some features, such as finding the nearest stop, may not work without it.
Camera. The app uses your device’s camera only to scan check-in codes, and only while that screen is open. Scanning happens on your device, and we do not store photographs or video from your camera. You can turn camera permission off at any time in your device settings, and enter your check-in code by hand instead.
Cookies and local storage. The website and app use cookies and your device’s local storage to keep you signed in, remember your selected location and preferences, and understand how the Services are used. You can block or delete cookies in your browser settings, but parts of the Services may stop working.
Analytics. We may use analytics providers that collect usage data through cookies and similar tools to help us measure and improve the Services.
Do Not Track. The Services do not currently respond to browser “Do Not Track” signals.
Cameras at locations. Operators and Host Facilities may use video and security monitoring in common, service, and equipment areas. Those recordings are controlled by the Operator or Host Facility.
Photos and testimonials. Use of your name, image, or testimonial in marketing is governed by the media release in the agreement you accept when you sign up, including your right to opt out.
7.Emails, text messages, and push notifications
Service messages. We and the Operator send messages about your account, bookings, payments, and schedule changes. These are part of the Services, and you cannot opt out of them while your account is active.
Marketing emails. You can unsubscribe at any time using the link in any marketing email.
Text messages. If you give us your mobile number and agree to receive texts, we or the Operator may text you booking reminders and, where you have separately agreed, offers. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. We do not share mobile numbers or text message consent with third parties for their own marketing.
Push notifications. You can turn push notifications on or off in your device settings.
8.Your choices and rights
- Access and update. You can view and update most account information in the app.
- Delete your account. You can delete your account from inside the app, under Account. This removes your account and personal information immediately, except for information we need to keep as described in Section 9. You can also email info@elixirmuscle.com.
- Access, correction, and copies. You can ask us for a copy of the personal information we hold about you or ask us to correct it.
- Marketing. You can opt out of marketing emails and texts at any time as described in Section 7.
- State privacy rights. Depending on where you live, you may have additional rights under state law, such as the right to know, correct, delete, or obtain a copy of your personal information, to opt out of certain uses, and to appeal a decision we make about your request. We will honor the rights that apply to you and will not discriminate against you for using them.
To make a request, email info@elixirmuscle.com. We may need to verify your identity before acting, and we will respond within the time required by law. Because Operators hold their own records, we may pass your request to the Operator of your location or ask you to contact them.
9.How long we keep information and how we protect it
Retention. We keep personal information for as long as your account is active and for as long afterward as we need it to provide the Services, meet legal, tax, and accounting requirements, resolve disputes, and enforce our agreements. Waiver, agreement, and incident records are kept after your account is closed, for as long as claims could be brought.
Security. We use reasonable administrative, technical, and physical safeguards to protect personal information, including encrypted connections and access limited to people who need it. No method of storage or transmission is completely secure, and we cannot guarantee absolute security. Please use a strong, unique password and tell us right away if you believe your account has been compromised.
Where information is processed. The Services are operated in the United States and are intended for people located in the United States. Your information is stored and processed in the United States.
10.Children and minors
The Services are not directed to children under 13, and we do not knowingly collect personal information directly from a child under 13. Accounts must be created by an adult age 18 or older.
A parent or legal guardian may add a minor to the parent’s account and accept the required agreements on the minor’s behalf. In that case we collect the minor’s information from the parent or guardian, who can review, update, or ask us to delete it at any time.
If you believe a child has given us personal information without a parent’s or guardian’s consent, email info@elixirmuscle.com and we will delete it.
11.Other sites and services
The Services may link to websites or services we do not control, such as a Host Facility’s website, social media platforms, or our payment processor. Their privacy practices are governed by their own policies.
12.Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will change the effective date at the top and, if the changes are material, notify you in the app or by email. Your continued use of the Services after an update means you accept the updated policy.
